Terms & Conditions

Deposit. As part of this Agreement, the Client is required to pay a deposit in the amount of $200 ("Deposit"). The Deposit shall be credited and deducted from the Rental, said Deposit shall be deemed non-refundable and can be transferred to a future date or booking. *Refer to inclement weather about a change due to weather.

Balance Due. The balance of the Rental Amount, less any deposit is due no fewer than 10 business days before the date of the event.

Overage. Any overage in time will be billed at the rate of $150/hr. for Photo Booth and $200/hr. for 360 Booth. Payment for any overage in time must be paid before additional hours will be, if the Event ends earlier than expected, no refund will be given.

Date Changes. Any date change request must be made in writing as soon as possible and no later than 14 days before the Event. The possibility of a given date change is subject to availability and the receipt of a new agreement to replace this Agreement. Both Parties must consent to such date.

Booth Failure. Should Say Queso fail to provide a fully operational Booth for the Event, the Client’s only remedy will be a full refund. In such event, the Client waives any claim on further consequential damages or if only partial services can be provided due to conditions beyond the reasonable control of Say Queso, the payments shall be negotiated at that time on a prorated basis.

Photo Booth Attendants Our booth attendants on site are trained with our equipment and as a liability reason CANNOT leave the booth unattended, as included in package. It is the attendants responsibility to assist with the booth & overall operations of the booth.

Length of Event The client agrees that the length of booking is set ahead of time. It is the clients responsibility to ensure they use the booth during their paid for hours, not Say Queso's responsibility. There will be no credits or refunds issued if the booth is not used by guests at any point during the allotted booking time.

TERMS AND CONDITIONS. Say Queso and the Client agree to the following Terms and Conditions:

Operations. Say Queso will deliver, set up, and remove the Booth(s) from the Event. Say Queso agrees to have a qualified technician onsite to maintain and operate the booth(s) at all times, as included in package.

Space and Placement. The Client will arrange for logistics necessary and access for Booth at the Event’s venue. Say Queso shall provide specifics related to space, shelter, power, and whatever else is deemed necessary must be met for the setup conditions to be considered adequate.

Damage to Equipment. The Client will be responsible for any damage or loss to the Say Queso's equipment due to misuse by the Client or any guest of the Client and in the case of theft or damage (due, but not limited, to fire, flood, or earthquake). If Say Queso judges the weather during the course of the Event to be inclement and thus unsafe, they reserve the right to cease operations for the safety of the equipment and of the Event’s attendees, in which case no refund will be issued.
INCLEMENT WEATHER

Say Queso reserves the right, in good faith, to cease the operation should the weather pose a potential danger to our personnel, the equipment, or guests. Since safety is paramount in all decisions, Say Queso's compensation will NOT be affected if the operation is ended.

If there is rain or bad weather in the forecast, Say Queso will contact Client to reschedule for a future date. The $200 deposit is non-refundable but can be transferred to a future date.

MODEL RELEASE (We will exclude this release upon request)

All guests using the photo booth hereby give to Say Queso: The right and permission to copyright and use, photographic portraits or pictures of any booth user who may be included intact or in part, made through any and all media now or hereafter known for illustration, art, promotion, advertising, trade, or any other purpose.

Liability and Indemnification. Say Queso will not be liable for direct, indirect, incidental or consequential damages (including, but not limited to, damages for lost profits or increased expenses) with respect to any claim related to this Agreement and the services. The Client will indemnify and hold harmless Say Queso and all technicians who are independent contractors working with Say Queso at the time against all liability related to the Event from its date and into the future. The Client will assume all legal fees claimed by third persons, provided that such loss or damage was not caused by the fault or negligence of the Provider or its employees, agents, or subcontractors.
